secThis position entails overseeing the efficient management of the litigation portfolio by facilitating the effective and timely prosecution and/or defense of disputes involving the company.
i) Providing research materials necessary for initiating legal proceedings in courts/tribunals
ii) Conducting evidence discovery for cases involving the Company
iii) Drafting pleadings and other pertinent documents for court/tribunal filings
iv) Facilitating communication with the Office of the Attorney General and Department of Justice as needed for litigation management
v) Assisting in witness preparations for trials/hearings and arranging witness attendance
vi) Implementing Alternative Dispute Resolution (ADR) mechanisms
vii) Initiating settlement discussions when appropriate for ongoing court/tribunal matters
viii) Representing the Company in court/tribunal hearings
ix) Drafting necessary communications to the Office of the Attorney General and Department of Justice regarding arbitral proceedings against the Company
x) Participating in all preliminary processes for arbitral proceedings, including document collation, drafting pleadings, filing with arbitral tribunals, arranging witness attendance, and managing proceedings until conclusion
xi) Participating in project site handovers and ensuring evidence preservation for potential arbitral processes thereafter
xii) Conducting legal research and providing detailed legal opinions as needed
xiii) Collaborating with other departments for operational efficiency
xiv) Updating and maintaining the litigation register
xv) Managing the litigation diary
xvi) Maintaining a repository of rulings and judgments
xvii) Assisting in the preparation, review, and implementation of internal policy documents
xviii) Suggesting potential improvements to internal processes and workflows
xix) Implementing Presidential Directives, Circulars, and Executive Orders
xx) Representing the Directorate in committee meetings
xxi) Providing legal advice on all matters related to laws, regulations, and policies affecting the Company's operations
xxii) Handling any ad-hoc legal issues that may arise
i) Possession of a Bachelor's degree in Law from an accredited institution
ii) Admission as an Advocate of the High Court of Kenya, membership in the Law Society of Kenya (LSK), and holding a valid practicing certificate
iii) Completion of a Post Graduate Diploma in Law from the Council of Legal Education
iv) At least three (3) years of relevant work experience
